1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between ИП ЖАСУЛАНОВ АЛИНУР ДАНИЯРОВИЧ (“Kvik”, “we”, “us”, or “our”) and the individual or business entity (“User”, “Customer”, or “You”) registering for or using the Kvik platform at https://app.usekvik.com and associated APIs, integrations, and services.

By creating an account, connecting any messaging channel, or using Kvik, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Description of Service

Kvik provides a cloud-hosted B2B software-as-a-service (SaaS) platform that enables businesses to:

• Centralize inbound and outbound communication across Instagram Direct Messages, WhatsApp Business, and Telegram.
• Deploy artificial intelligence (AI) agents to assist in responding to customer inquiries, booking appointments, and organizing CRM leads.
• Manage customer profiles, message histories, and business analytics.

3. Account Registration & Security

1. Eligibility: You must be at least 18 years of age and hold the legal authority to represent your business entity to register for Kvik.
2. Account Integrity: You must provide accurate, current, and complete information during registration.
3. Credential Security: You are responsible for safeguarding your login credentials and are solely liable for all activities occurring under your account.

4. Third-Party Messaging Platform Compliance

When integrating third-party messaging services with Kvik, you agree to comply with all relevant platform policies:

• Meta Platform Terms & Developer Policies: You will not use Kvik to violate Meta's policies, transmit unsolicited spam, or harvest user data unlawfully.
• WhatsApp Business Messaging Policy: You agree to send messages only to users who have provided explicit opt-in consent and to respect standard customer service response windows.
• Instagram Community Guidelines: You will ensure all automated and human interactions adhere to Instagram's community standards.

We reserve the right to suspend or terminate any integration or account that violates third-party platform terms or risks the reputation and API access of Kvik.

5. AI Capabilities & Output Disclaimer

Kvik integrates advanced large language models (LLMs) to generate conversational responses:

• Automated Suggestions: AI responses are generated based on the business data, working hours, and knowledge base you configure.
• Accuracy: While our AI engine is optimized for high accuracy and context awareness, Kvik does not guarantee that every AI-generated response is 100% error-free.
• Customer Responsibility: You retain full ownership and discretion over how AI automations are configured in your workspace and whether human-in-the-loop oversight is enabled.

6. Intellectual Property

1. Kvik Property: The Kvik platform, source code, user interface, design, algorithms, logos, and trademarks remain the exclusive intellectual property of ИП ЖАСУЛАНОВ АЛИНУР ДАНИЯРОВИЧ.
2. Customer Data: You retain full ownership of your business data, customer records, and messaging content uploaded to or processed through Kvik.

7. Limitation of Liability

To the maximum extent permitted by applicable law of the Republic of Kazakhstan:

• Kvik is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
• In no event shall ИП ЖАСУЛАНОВ АЛИНУР ДАНИЯРОВИЧ be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business interruption) arising from your use of the platform or temporary outages of third-party APIs (such as Meta or Telegram).

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan. Any disputes arising from or relating to these Terms shall be resolved through good-faith negotiation, or, failing that, submitted to the competent courts of the city of Almaty, Republic of Kazakhstan.
